Habitat Equivalency Analysis and Trustee engagement strategy delivers rapid settlement resolution in multi-PRP case 

When natural resource Trustees pursued natural resource damage claims against multiple potentially responsible parties (PRPs) for a confidential site in Ohio, our client faced business uncertainty as a minor contributor among several PRPs. Through strategic Trustee engagement, local knowledge, and rigorous habitat equivalency analysis, we eliminated prolonged negotiations and unfair liability allocation risks. Our approach resulted in a negotiated settlement that resolved our client’s liability while contributing to a major habitat enhancement project.

Challenge

Multi-PRP natural resource damage cases require strategic positioning to achieve proportionate liability allocation. 

Our client faced a natural resource damage claim brought by Federal Trustees for alleged injuries at a confidential site. As a minor player among multiple PRPs, our client wished to avoid disproportionate liability allocation that could occur if other PRPs settled at different times. The Trustees and our client held differing views on appropriate compensatory restoration projects and the scale of our client’s responsibility, creating negotiation challenges that required technical analysis and strategic positioning.  

Our Role

Integral provided natural resource damage assessment (NRDA) settlement expertise combined with local knowledge to develop a favorable negotiation strategy. 

Our team brought experience negotiating natural resource damage settlements, an understanding of Trustee priorities, and local knowledge of restoration opportunities. We provided strategic advice and negotiation support while conducting technical analyses to support our client’s position. Our approach focused on educating the client about NRDA processes, building trust with Trustees through structured meetings, and identifying compensatory restoration projects that aligned with Trustee priorities while supporting a proportionate settlement for our client. 

What We Delivered

Comprehensive technical analysis and negotiation strategy that positioned our client for favorable settlement terms. 

Using habitat equivalency analysis and restoration project identification and prioritization, we developed presentations that demonstrated the value of service losses and gains from preferred restoration projects. We researched candidate compensatory restoration projects and presented analyses in terms that aligned with Trustee priorities. Our technical work provided the foundation for settlement negotiations while our strategic approach built the trust necessary for productive discussions with Trustees. 

The Result

Successful settlement resolves liability while helping to fund a significant habitat enhancement project. 

Our analysis and negotiation support resulted in a favorable settlement that eliminated business uncertainty for our client and contributed funding for an important habitat enhancement project. The resolution was achieved in less than 1 year, ending a prolonged period of uncertainty and establishing clear liability resolution. The settlement included $1.75 million in third-party funding incentives provided by Trustees, demonstrating the collaborative approach we developed with regulatory stakeholders.
