When New Jersey Department of Environmental Protection (NJDEP) approached our client about voluntarily conducting a natural resource damage assessment (NRDA) at their active manufacturing site in Salem County, the client faced an unfamiliar regulatory process with uncertain timeline and costs. Rather than pursuing traditional adversarial approaches that can extend NRDA processes for many years, Integral developed a collaborative strategy that achieved resolution in just 18 months while placing valuable wetland and forest habitat into permanent conservation.

Challenge

Voluntary NRDA requests require strategic response to achieve efficient resolution while protecting client interests. 

Our client received an unusual request from NJDEP to voluntarily conduct a NRDA for their manufacturing facility—a 120-acre property that includes a 10-acre manufacturing plant dating to the late 1800s, with the remainder consisting of tidal wetlands, tidal creeks, and forest. The client had no prior NRDA experience and required straightforward help in understanding the process, potential outcomes, and strategic options. With significant reputational considerations in the local community, the client needed an approach that would demonstrate environmental stewardship while achieving cost-effective regulatory resolution. 

Our Role

Integral provided NRDA expertise combined with regulatory negotiation experience to develop a collaborative resolution strategy. 

Our team brought specialized natural resource damage assessment capabilities, conservation planning experience, and established relationships with NJDEP to guide the client through the voluntary process. We identified that the client owned substantial surrounding lands, including wetlands and farmland, presenting an opportunity to focus on compensatory restoration through land conservation rather than extended technical disputes. Our approach emphasized collaboration with regulators through structured online and in-person meetings while utilizing commonly accepted and peer-reviewed NRDA calculation software to maintain technical rigor and build consensus. 

What We Delivered

A collaborative framework that streamlined the NRDA process while introducing innovative conservation-based compensation. 

Through strategic planning and structured stakeholder engagement, we developed comprehensive NRDA reports and meeting presentations that used established calculation methodology. Our approach introduced land conservation as a means of compensating for past environmental injuries—an uncommon but effective strategy in NRDA settlements. We also identified the need for specialized NRDA legal counsel and facilitated engagement of experienced New Jersey NRDA attorneys to support the collaborative process. 

The Result

Early resolution achieved in 18 months with significant cost savings and positive community impact. 

Our collaborative approach resulted in rapid NRDA resolution with NJDEP, reducing what typically becomes a multiyear process to just 18 months. The resolution preserved the client’s community reputation while demonstrating environmental leadership through permanent land conservation. The collaborative and settlementoriented framework avoided extended regulatory disputes and associated legal and consulting costs while delivering measurable environmental benefits through habitat protection.
